Terms of Service

These Terms form a binding agreement between you and M9ND LLC ("M9ND," "we," "us," or "our"). If you do not agree, do not use the site or our services. If you use the site on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

You must be at least 18 years old and able to form a binding contract to use the site and our services.

We provide privacy and operational-security consulting, educational content, and related services. Information on this site is general and informational and is not legal, financial, or security advice for your specific situation. Paid engagements are governed by a separate, signed Service Agreement and related documents (described in our Agreements summary), which control over these Terms in the event of any conflict for that engagement.

Some features, such as our membership, require an account or subscription. You are responsible for the information you provide and for activity under your account, and you agree to provide accurate information and keep it current.

Payments are processed by our payment provider, Stripe. Fixed-price deliverables are described before purchase. Subscriptions renew automatically for the stated period until cancelled; you may cancel a subscription at any time, effective at the end of the current billing period, and cancellation stops future charges but does not retroactively refund the current period unless required by law. Refund and cancellation terms for bespoke engagements are set out in the applicable Service Agreement. Taxes, where applicable, are your responsibility.

Privacy is an ongoing practice, not an absolute state. Data re-populates and new sources appear over time. We do not guarantee total anonymity, complete or permanent removal of your information, or any specific outcome. We describe what we can reasonably reduce and how to maintain it; you are responsible for following recommendations and maintaining your own practices.

You agree to use the site and our services only for lawful purposes. Our services help you control and reduce your own data exposure and harden your own accounts and property. You may not use them to evade lawful legal process, defraud or harm any person, harass or stalk anyone, infringe others' rights, or conceal assets from courts or legitimate creditors. You may not attempt to disrupt, reverse engineer, or gain unauthorized access to the site.

The site and its content, including text, design, graphics, and materials we provide (such as reports and guides), are owned by M9ND or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable license to access and use the site and any materials we provide to you for your own use. You may not reproduce, distribute, resell, or create derivative works from our materials without our written permission.

The site may reference or link to third-party tools, services, or content. We do not control and are not responsible for third parties, and a reference is not an endorsement. Your use of third-party services is governed by their terms.

To the maximum extent permitted by law, the site and our informational content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, M9ND and its members, officers, and personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or relating to your use of the site or these Terms. Our total aggregate liability for any claim relating to the site or these Terms will not exceed the greater of the amount you paid us for the site service giving rise to the claim in the twelve months before the claim or one hundred US dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Liability for a paid engagement is governed by the applicable Service Agreement.

You agree to indemnify and hold harmless M9ND and its members, officers, and personnel from and against any claims, losses, liabilities, and reasonable expenses (including legal fees) arising out of your misuse of the site, your violation of these Terms, or your violation of any law or the rights of a third party.

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Before bringing any formal claim, you agree to first contact us and attempt to resolve the dispute informally in good faith for at least 30 days. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction and venue of the state and federal courts located in Wyoming, and you consent to that jurisdiction, except where applicable law provides otherwise.

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above, and your continued use of the site after an update constitutes acceptance of the revised Terms.

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with any applicable Service Agreement and our Privacy Policy, are the entire agreement between you and M9ND regarding the site.
